You are responsible for maintaining the security of your Google account credentials.
4. User Roles and Responsibilities
a. Event Hosts:
Own and control RSVP data collected from guests, sent via email (AWS SES) and retained in Grape4invite’s database.
Define mandatory (e.g., full name) and optional custom fields (e.g., age, dietary preferences).
Must use guest data solely for event purposes and comply with applicable data protection laws.
Are responsible for handling guest data requests (e.g., deletion) for their email copy, as Grape4invite’s deletion does not affect host-retained data.
b. Event Guests:
Must provide their full name to RSVP, plus any host-defined mandatory fields.
May provide optional custom fields or choose not to RSVP if they disagree with mandatory fields.
May submit data on behalf of others (e.g., minors under 13, friends, relatives) but are responsible for obtaining consent from those individuals.
Can request data deletion from Grape4invite’s database by emailing legal@squaregrape.net, but must contact the host separately for their copy of the data.
5. Guest RSVP Data Ownership
Hosts define the data collected from guests (e.g., full name, custom fields like age or phone).
RSVP data is stored in Grape4invite’s database and sent permanently to the host’s email inbox via AWS SES.
Guests should verify they trust the host before submitting RSVP data, as hosts retain a copy even if Grape4invite deletes its database records.
Guests submitting data for others (e.g., minors under 13, family members) are responsible for obtaining consent.
Guests may request deletion of their data from Grape4invite’s database by emailing legal@squaregrape.net, but must contact the host separately for their copy.
6. Host Responsibilities
Hosts must use guest RSVP data solely for event-related purposes (e.g., planning, communication).
Hosts must not share, sell, or misuse guest data beyond the event’s scope.
Hosts must comply with applicable data protection laws (e.g., GDPR, CCPA) when handling guest data.
Hosts are responsible for handling guest requests for data access or deletion for their email copy, as Grape4invite’s database deletion does not affect host-retained data.
7. Privacy
Your use of Grape4invite is subject to our Privacy Policy, which details how we collect, use, and protect your personal information. By using the app, you consent to the Privacy Policy’s terms, including data collection via Google Sign-In and AWS services.
8. Age Restriction
Grape4invite is not intended for users under 13 years old. Minors under 13 may not use the app.
Parents or guardians submitting RSVP data for minors under 13 are responsible for obtaining consent and ensuring compliance with these Terms.
9. Intellectual Property
All content provided by Grape4invite (e.g., text, graphics, logos, software) is owned by Grape4invite or its licensors and protected by intellectual property laws.
You may not reproduce, distribute, or modify our content without prior written permission.
User-generated content (e.g., event images, RSVP fields) remains your property, but you grant Grape4invite a non-exclusive, royalty-free license to use, store, and display it for app functionality (e.g., via AWS S3).
10. Termination
We may suspend or terminate your account and access to Grape4invite at our discretion, with or without notice, for violations of these Terms, harmful conduct, or legal requirements.
Upon termination, your account data may be deleted from our database, but RSVP data sent to hosts remains with them.
11. Disclaimer of Warranties
Grape4invite is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the app's operation or the information, content, or materials included therein. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
12. Limitation of Liability
In no event shall Grape4invite or its affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of or inability to use the app, whether based on contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.
13. Indemnification
You agree to indemnify, defend, and hold harmless Grape4invite, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the app.
14. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these Terms will be resolved through binding arbitration in Florida, USA, under the rules of the American Arbitration Association.
You waive the right to participate in class action lawsuits against Grape4invite.
16. Changes and Contact
We may update these Terms at any time. We will notify users of significant changes via email (AWS SES) or in-app notifications.
Continued use of Grape4invite after changes constitutes acceptance.
